Mesothelioma Prognosis: Do We Really Want to Know How Long We Have to Live?

Cancer is something we all fear, and with very good reason. Unlike most diseases, there are many different types of cancer and it can affect any part of the body. Worse still, cancer has the ability to spread (metastasize), and this makes it very difficult to cure.


Cancer also has a way of sneaking up on people and can be in an advanced stage before a person even becomes aware they are ill. Due to this, a cancer diagnosis can often come with a poor prognosis, and doctors are faced with the unenviable task of passing the sad news onto their patients and their families.


The word “prognosis” comes from the ancient Greek, meaning “foreseeing or foreknowledge.” This is what doctors rely upon when they are dealing with a person who has cancer.


Extensive research into the causes and types of cancer, plus their treatment and survival rates, has been carried out over a period of many years, and the documented evidence that comes from this research is what doctors use to help them determine the expected outcome of a person who has been diagnosed with cancer.


Depending on which type of cancer they have and the stage (spread) of the cancer, doctors determine the average survival rate of patients who have suffered from the same type of cancer in the past and then predict a possible life expectancy for the newly diagnosed cancer patient.


No matter who we are, there is one truth in life that we cannot avoid, and this is the fact that no one can live forever. Like it or not, we must all accept that there will come a day when our life comes to an end.


Accepting that we are going to die someday is one thing; being told when this event is likely to happen is an entirely different matter.


“You are dying” is the cruelest thing that anyone could say to another person, and this is exactly what a doctor is saying to a patient when he or she gives a terminal diagnosis, followed by a prognosis of how long a person is expected to live.


Whether the prognosis is for one month, six months or a year, the emotional impact for the patient and their loved ones is the same, and from that point onward, the thought of impending death weighs heavily on their mind.


And this brings the question of prognosis to the forefront: When someone has been diagnosed with an incurable cancer, do they really need to be told when they are expected to die? 


The answer to this question is no; there is no law that states that a doctor has to give a terminally ill patient an estimate of how long they have to live. The fact remains that no matter whether they tell the patient or not, it will not make a difference in the outcome. 


This aside, there are cancer patients who want to know how long they are expected to live and will request this information from their doctor. 


Their reasons for wanting to know their life expectancy can be varied, but most often it is because they want to put their affairs in order.  


On the other hand, there are also cancer patients who do not wish to know how long they are expected to live and have no intention of asking the doctor for this information.


The reasons for patients not wanting to know their prognosis can also be varied. It could be that they are not yet ready to accept that they are dying and choose to live in hope of a cure. Or it could be that they accept that they are going to die from their disease eventually, but don’t want the expected time of their death to be hanging over their head.


Cancer is most certainly a disease from which many people are suffering, however each and every one of them is an individual and no two people will deal with a cancer diagnosis in the same way.  


For this reason, I believe that every cancer patient should be given the opportunity to decide whether they wish to know how long they are expected to live. 


If a doctor gives his or her opinion of this without first asking the patient what their wishes are, they are robbing the patient of the ability to choose, and this can dramatically affect how they deal with their terminal diagnosis.


One person who definitely did not want to be told how long he had to live was my husband, Brian, yet he was brutally told this at the time of his mesothelioma diagnosis. While I can accept that telling a patient there is no cure for their disease can never be easy, I believe that doctors need to show compassion and respect for those who are receiving this tragic news. 


Brian’s prognosis shattered us, and the range of months he was given made it even worse. “Three to nine months, I reckon,” was a brutal way to learn that Brian was dying.


Not knowing if Brian would live for three months, nine months or somewhere in between was the cruelest torture. We could not get the thought of his impending death out of our minds. It was impossible not to count down to the time when he was expected to die, and we saw every passing day as bringing us even closer to it.


When nine months had passed, Brian said to me, “I have proven them wrong; this cancer is not going to beat me.”


No longer having the date of his expected death hanging over his head, Brian had found hope, and the change in his emotional well-being was wonderful to see.


Contrary to his prognosis of three to nine months, Brian lived for two years, which is testament to the fact that prognosis is only a doctor’s opinion and is not necessarily correct.


The hardest thing for me to bear when I was caring for Brian during his mesothelioma illness was that there was no cure for this disease, and that because of this, there was no hope for a future together.


Despite this, I instinctively knew that Brian needed to live in the hope that he would survive, and I supported him in this at every opportunity.


Hope is a vital component for people who are living with cancer, and even when the hope of survival  is no longer possible,  patients can still hope that their remaining life will be free of pain and that they will be comforted and supported as they face their death.


By being intuitive, doctors can learn a lot about the way cancer patients deal with their cancer diagnosis and find better ways to support patients and their families at these distressing times.


It is important for them to understand that although they may not share a patient’s hopes, they should nonetheless respect them.


Perhaps the best way for doctors to deal with the difficult issue of prognosis is to heed the advice of Dr. Elisabeth Kubler-Ross, one of the foremost authorities in the field of death. On the topic of prognosis, she says:


“You have to be honest, but you don’t have to be totally honest. You have to answer their questions, but don’t volunteer information for which they have not asked, because that means that they are not ready for it yet.


“Without miracles, there are many, many ways of helping somebody without a cure. So you have to be very careful how you word it. And never, ever take hope away from a dying patient. Without hope, nobody can live.”

Recent Milwaukee Mesothelioma Case

Recently, I met with a man who worked his whole career at Wisconsin Electric a/k/a WE Energies.  He worked at various power plants in Wisconsin, including the Oak Creek power plant, downtown Milwaukee plant, the valley power plant in Milwaukee, the Pleasant Prairie plant, and various other power plants and substations.   A couple of the jobs he worked in around asbestos included electrical work, plumbing related work, and oil treatment work.  The asbestos was in gaskets, insulating pipes, used around wire and joints, etc.  Sadly, he was living a nice life in Florida enjoying retirement when he was diagnosed with malignant mesothelioma, a deadly disease, related only to asbestos exposure.  He had been suffering from shortness of breath when his doctor discovered fluid on his lungs.  Eventually, a thoracic surgeon was seen and he did a biopsy, which led to the definitive diagnosis of asbestos-related mesothelioma.

Mesothelioma caused by restaurant oven seals


Mesothelioma has long been considered an industrial disease; patients diagnosed with mesothelioma often have a background in mining, shipbuilding, fuel refineries and other large-scale works. This is due to the cancer’s cause, asbestos, being used in such industries for its fire resistance, durability and insulating qualities. Industrial employees were often in direct contact with raw asbestos, greatly heightening their chances of fiber inhalation that leads to mesothelioma.


However, the amount of mesothelioma cases that have come out of direct asbestos contact could be greatly surpassed by slower, subtler exposure.  Through the last century countless construction and consumer products were built and manufactured using asbestos as a stabilizer. Now, decades later those components are beginning to break down. Floor and ceiling tiles that were once intact have endured years of wear and tear. Older buildings are being torn down and replaced. Through slow damage and intentional demolition asbestos fibers are being released into the air causing a threat to public safety.


One man knows too well that you don’t have to work in a shipyard or oil refinery to develop fatal mesothelioma. Luigi Pes, an Italian chef in Salisbury England, was diagnosed early in 2008 with mesothelioma after being exposed to asbestos during his employment at La Gondola restaurant in the 1980s. In addition to some asbestos-containing ceiling material present in the establishment, Pes believes asbestos in the oven seals of the restaurant’s kitchen caused his case of mesothelioma.


In the Salisbury Journal’s July 5th article on the topic, Pes says, “For many years I worked there with no idea about the damage asbestos could do to my health. In later years when I became aware about the dangers of asbestos, I had an idea that I had been exposed but I never expected that I would end up with this disease.


“Despite my progressive illness and the restrictions it brings, I’m doing my best to enjoy each day I have left. I’m not angry but I do feel strongly that more should have been done to protect me from getting this disease.”


Pes sought legal action and was able to settle out of court for a six-figure compensation amount. Pes is married and has two grown children. His attorney, Stephen Loach, from legal firm, Thompsons Solicitors, says in the same Salisbury Journal article: “I investigated the case for Mr. Pes urgently and pursued it vigorously so that he could benefit from the compensation during his lifetime. While this will never make up for Mr Pes’ poor health it will at least afford him some financial relief and the knowledge that the employers who caused his suffering have been held to account.”

What is Mesothelioma?

Once rare, malignant mesothelioma is the most serious of asbestos-related diseases.  Though mesothelioma is still relatively uncommon, numbers of individuals with the disease are growing due to more sophisticated screening measures and increased understanding of the cycle of latency of the disease.


 


Pleural mesothelioma affects the lung’s lining in the chest and represents the majority of mesothelioma incidence.  Peritoneal mesothelioma, affecting the abdominal cavity, and pericardial mesothelioma, affecting the cardiac cavity are less common.


In the majority of patients, most of whom are over 60 years of age, symptoms like shortness of breath and chest pain can mimic other ailments.  And since mesothelioma can take 15 to 50 years to develop, it can be a challenge to diagnose.  Specialists with more experience can be more adept at catching the disease.


Diagnosis requires a body scan, either through magnetic resonance image (MRI) or computer topography (CT scan).  These images can help to locate areas of concern and determine size, which informs surgeons where to perform biopsies.


Caught in its early stages mesothelioma is treatable with chemotherapy, radiation treatments, and some surgical interventions.  Even in later stages, these are treatments that may be employed in varying ways, depending on whether the cancer is localized or has spread.


Unfortunately, because of the challenges with diagnosis, the disease is usually caught in later stages and has a poor prognosis.  Even still, advances in treatment can help extend formerly grim prognoses.


Knowing what mesothelioma is and where it comes from can help guide doctors in coming to a correct diagnosis earlier, helping lead to better outcomes.  A doctor who hears a patient say, “I’m having chest pains and shortness of breath” might assume cardiovascular issues and test to that end.


But a doctor, upon hearing, “I worked in the building trades in the 60s and wonder if it might be mesothelioma” might take a more assertive diagnosis stance.  Additionally, earlier diagnosis can help get patients compensation through legal action.


Mesothelioma is caused by exposure to asbestos.  Asbestos is a strong, fireproof and affordable mineral that was used extensively in shipbuilding in World War II, where the material was used to wrap the pipes, line the boilers, and cover engine and turbine parts.


Asbestos was also used in construction and other trades through the 1960s. Drywall and joint compound, plaster and mud used asbestos, as did many types of flooring, and “popcorn” ceilings. In dentistry, asbestos was used in dental cast linings, and brake pads and shoes have also used this material.


In the 1970s, court documents proved asbestos industry officials knew of the dangers of the material, but didn’t communicate these risks. Consequently, the use of asbestos declined, and the asbestos companies are financially liable for diseases like mesothelioma.

Action Mesothelioma Day 2013

Action Mesothelioma Day 2013 holds its 8th annual national event on Friday 5th July.


Each year since 2006, many local mesothlioma patient support groups, national organisations and charity trusts will stage different events around the country from the many former asbestos industry ‘blackspots’ in Merseyside, Derbyshire, Greater Manchester and the West Midlands to Bristol, London and Plymouth.


Held on the first Friday of July, Action Mesothelioma Day brings together many organisations and individual speakers from the medical, legal and caring professions both here in the UK and from the US. Presentations and commemorative ceremonies are accompanied by talks and seminars aimed at not only helping to support and remember those whose lives were fatally affected by working with or exposed to the deadly material but also to raise asbestos awareness to the continued risk of mesothelioma and asbestosis disease.


Manchester


In Manchester, the day will once again be marked by the Greater Manchester Asbestos Victims Support Group who will release sponsored doves opposite Manchester Town Hall in memory of all those who have died from mesothelioma. A public meeting will then be held in which Len McCluskey, General Secretary of Unite the Union will deliver a speech entitled “Asbestos – Protecting Workers Today”.


Despite the ban on using white asbestos in building materials from late 1998 many trade occupations are still most likely to have direct contact with the many types of asbestos insulation still to be found in both public, commercial and residential properties around the UK. Today, among the most vulnerable to asbestos exposure are demolition workers, builders, carpenters, HVAC (heating, ventilation, and air conditioning) installers, plumbers, electricians, plasterers, tilers, roofers, painters and decorators.


According to a recent national survey, a quarter of tradesmen admit to being unaware of coming into direct contact with asbestos, just one in six of building maintenance contractors say they have asbestos training qualifications and only one in eight claim to have a good working knowledge or qualifications in asbestos.


Cheshire and Merseyside


The Cheshire Asbestos Victims Support Group once again team up with the Merseyside Asbestos Victims Support, and will also release sponsored doves at Liverpool Town Hall. Lectures will be presented by guest consultant respiratory, pulmonary and lung specialists from the local Aintree Chest Centre and the University of Pennsylvania Medical School, USA.


Despite continuing advances in asbestosis treatments in recent years, which means it is possible for around a half of mesothelioma patients to be able to live for around two years, research into finding a cure for the incurable and fatal mesothelioma cancer continues to make slow progress.


Leeds


In Leeds, The June Hancock Mesothelioma Research Fund (JHMRF) in collaboration with the Mesothelioma Support Yorkshire Group (MESSY) and the MARC group (Mesothelioma and Asbestos Related Concerns) will feature talks given by a mesothelioma patient who will share their personal perspective of the condition and its treatment, the psychological aspects of mesothelioma and work updates from two JHMRF funded researchers.


Other Action Mesothelioma Day 2013 events are being held by Asbestos Support West Midlands, South Yorkshire Asbestos Victim Support, Bristol and Beyond Asbestos Family Support, Papworth Mesothelioma Support Group, South Yorkshire Asbestos Victim Support, Berkshire Asbestos Support Group, Derbyshire Asbestos Support Team, Mick Knighton Mesothelioma Research Fund, South West Mesothelioma Support Group, and the London Hazards Centre.

Glossary of Medical Terms Relating to Mesothelioma

Laparoscope (laparoscopy)
A laparoscope is a lighted tube that is inserted into the abdomen to examine the abdominal wall. The procedure is called a laparoscopy. (See also peritoneoscope/peritoneoscopy)


Laparoscopy
A procedure involving the insertion of a thin, lighted tube (called a laparoscope) through the abdominal wall to inspect the inside of the abdomen.


Local anesthetic
A drug or anesthetic that causes a temporary loss of pain or feeling in a part of the body. When a local anesthetic is used during a medical procedure, the patient usually remains awake.


Localized mesothelioma
Mesothelioma that has not spread to other organs of the body.


Lung
One of a pair of organs in the chest that supplies the body with oxygen and removes carbon dioxide from the body.


Lymph nodes
Small oval bodies contained throughout the body that contain lymph. Lymph nodes act as a first line of defense against infections and cancer.


Malignant
Cancerous cells that are capable of spreading to other parts of the body.


Malignant mesothelioma
A type of cancer in tissue surrounding the lining of the lungs, abdomen or heart. Asbestos exposure is considered the primary cause of malignant mesothelioma.


Mediastinoscopy (MEE-dee-a-stin-AHS-ko-pee)
A mediastinoscopy is a procedure in which a lighted tube is inserted into the chest to view the organs in the area between the lungs and nearby lymph nodes. The tube is inserted through an incision above the breastbone. This procedure is often performed to obtain a tissue sample from the lymph nodes on the right side of the chest.


Mediastinum
The mediastinum is the partition between the lungs, formed by the adjoining walls of the pleura, and between the lungs and the lymph nodes.


Mesothelial cells (mesothelium tissue)
The general name for the specialized cells that comprise the membrane that lines the lungs, abdomen, heart and other organs in the body. The layer of cells is called mesothelium tissue.


Mesothelioma
A benign (non-cancerous) or malignant (cancerous) tumor affecting the lining of the lungs (pleura), abdomen (peritoneum) or heart (pericardium). Asbestos is the primary cause of mesothelioma.


Metastasis (meh-TAS-ta-sis)
Metastasis is the spread of cancer from one part of the body to another. A tumor formed by cells that have spread is called a “metastatic tumor” or a “metastasis.” The metastatic tumor contains cells that are like those in the original (primary) tumor. The plural form of metastasis is metastases (meh-TAS-ta-seez).


Metastatic (MET-uh-STAT-ik)
Having to do with metastisis, which is the spread of cancer from one part of the body to another.


Metastatic tumor
A malignant tumor that has spread from the place in which it started to other parts of the body.


MRI (magnetic resonance imaging)
A sophisticated test that provides in-depth images of organs and structures in the body.


Oncologist (on-KOL-o-jist)
An oncologist is a doctor who specializes in treating cancer. Some oncologists specialize in a particular type of cancer treatment. For example, a radiation oncologist specializes in treating cancer with radiation.


Oncology
The study of cancer. An oncologist is a physician who specializes in cancer treatment.


Palliative radiation
Radiation treatment aimed at relieving pain and symptoms of disease, but not intended to cure the disease.


Paracentesis
The process of removing fluid from the abdomen.


Pathologist
A doctor who identifies diseases by studying cells and tissues under a microscope.


Pathology
The study of the essential nature of diseases and especially of the structural and functional changes produced by them. To diagnose a particular form of cancer, a pathologist examines a piece of the cancerous tissue under a microscope to determine the size and type of cancer cell.


Pericardial mesothelioma
Cancer of the sac that surrounds the heart.


Pericardiocentesis
The process of removing fluid from the sac around the heart.


Pericardium
The lining that surrounds the heart.


Peritoneal mesothelioma
Cancer of the lining that surrounds the abdominal cavity.


Peritoneoscope
A peritoneoscope is a lighted tube that is inserted into the abdomen to examine the abdominal wall. The procedure is called a peritoneoscopy. (See also laparoscope/laparoscopy)


Peritoneoscopy
Procedure to examine and treat abdominal and pelvic organs, using a small surgical viewing instrument (laparoscope) inserted into the abdomen.


Peritoneum
The lining that surrounds the abdominal cavity.


PET (Positonic Emission Topography) scan
A procedure in which a small amount of radioactive glucose (sugar) is injected into a vein, and a scanner is used to make detailed, computerized pictures of areas inside the body where the glucose is used. Because cancer cells often use more glucose than normal cells, the pictures can be used to find cancer cells in the body.


Pleura
The lining that surrounds the lungs and prevents the lungs from rubbing against the ribs.


Pleural cavity
The space between the lungs and the chest wall. The cavity is lined by the pleura.


Pleural effusion
The collection of fluid in the space between the pleura (the lining of the lungs) and the general space inside the chest, also known as the chest cavity.


Pleural mesothelioma
Pleural mesothelioma is a cancer of the lining that surrounds the lung.


Pleurectomy (decortation)
A surgical procedure to remove the pleura, where the cancerous mesothelioma tumor has lodged, along the inner chest wall. It is used to control effusions and ease pain.


Pleurodesis
A procedure used to treat fluid build-up (effusion) within the pleural space or cavity. A medical procedure using chemicals or drugs to cause inflammation and adhesion between the layers of the pleura (the tissue that covers the lungs and lines the interior wall of the chest cavity). This prevents the build-up of fluid in the pleural cavity. It is used as a treatment for severe pleural effusion.


Pneumonectomy
The surgical removal of a lung.


Prognosis
The projected outcome of a disease; the life expectancy.


Protocol
A treatment plan.


Radiation therapy
Intensive x-ray treatment that damages or kills cancer cells.


Radioisotope
An unstable element that releases radiation as it breaks down. Radioisotopes can be used in imaging tests or as a treatment for cancer.


Recurrence
The reappearance of a disease after a period of remission.


Regression
The shrinkage of cancer growth.


Remission
The complete or partial disappearance of the signs and symptoms of disease.


Risk factor
Anything that increases a person’s chances of developing cancer, for example, asbestos exposure and mesothelioma.

Sample Types In The Diagnosis Of Mesothelioma

Depending on the type of mesothelioma and clinical presentation, there are several samples that may independantly and collectively be examined to diagnose mesothelioma. Optimisation of sampling is crucial as it can greatly affect and inhance the pathpologist’s ability to offer a correct diagnosis.


Although wedge biopsies – and even open biopsy via thoractomy – are sometimes required to establish a diagnosis for mesothelioma, there are several less invasive forms of sampling which may be diagnostic in some settings.


These latter samples are discussed as below:


Effusion Fluid


When a serous effusion is present an adequate sample (preferably over 50ml of fluid) should be collected and sent to the cytology laboratory; this will enable smears and a cell block to be prepared. In addition, som of the cell deposit can be set aside for ultrastructural examination. A definate diagnosis of malignant mesothelioma can be made on cytology of effusions in the majority of cases.



Closed Needle Biopsy


Although taking a close needle biopsy (of the Abrahams’ type) at the time of tapping the effusion was the standard practice in the past, there has been a reduction in this form of sampling related to a significant proportion of inadequate or inconclusive biopsies. The high diagnostic yield from effusion cytology has probably also influenced this decline.



Fine Needle Aspiration (FNA)


Over the past years – there has been an increase in thin core sampling for plueral-based lesions, especially where there is no accompanying serous effusion. This procedure is well tolerated by patients who require only a simple local anaesthetic.

Mesothelioma victim wins settlement from former employer

A man from Tyneside, England has won a payout from his former employers. 18 months ago, Mr. Wilfrid Craig was diagnosed with mesothelioma, a rare form of cancer caused almost exclusively by exposure to asbestos fibers. While there are palliative treatment methods available, including chemo, there is no known cure for mesothelioma cancer. The disease typically lies dormant for up to fifty years before an individual begins to suffer from mesothelioma symptoms, and the majority of patients lose their battle with this cancer in less than two years following diagnosis.

“I am so angry to think my life and those of my wife and children have been torn apart unnecessarily because of my former employers’ negligence,” he told reporters. “Throughout my employment I was never provided with a mask or any protective clothing because I was working with asbestos. Had I been given this equipment to protect myself I wouldn’t be in this dreadful situation. I was absolutely devastated when I received my diagnosis and as a result I’ve now had to leave my job.”

According to Roger Maddocks, an industrial illness specialist with the law firm Irwin Mitchell, “Throughout Mr. Craig’s employment at George Wimpey & Co, and due to his position at the time, he was routinely tasked with duties which often involved working closely with asbestos without any form of protective equipment.

Mr Craig is just one of the thousands of workers who have either been killed by, or are now facing, a devastating terminal illness because their employers did not take the necessary precautions to protect them when they either knew or should have known of the risks.”

Mesothelioma Facts and Figures

Mesothelioma (cancer of the mesothelium) is a disease in which cells of the mesothelium become abnormal and divide without control or order. They can invade and damage nearby tissues and organs. Cancer cells can also spread (metastasize) from their original site to other parts of the body. Most cases of mesothelioma begin in the pleura or peritoneum.


 


The mesothelium is a membrane that covers and protects most of the internal organs of the body. It is composed of two layers of cells: one layer immediately surrounds the organ; the other forms a sac around it. The mesothelium produces a lubricating fluid that is released between these layers, allowing moving organs (such as the beating heart and the expanding and contracting lungs) to glide easily against adjacent structures.


The mesothelium has different names, depending on its location in the body. The pleura is the membrane that surrounds the lungs and lines the wall of the chest cavity. The peritoneum is the mesothelial tissue that covers most of the organs in the abdominal cavity. The pericardium covers and protects the heart. The mesothelial tissue surrounding the male internal reproductive organs is called the tunica vaginalis testis. The tunica serosa uteri covers the internal reproductive organs in women.


The most prevalent form of this asbestos cancer is pleural mesothelioma, which arises in the pleura (the lining of the lungs and chest cavity). Peritoneal mesothelioma affects the lining of the abdominal wall, the peritoneum. Pericardial mesothelioma affects the pericardium, the lining of the heart.


These cancers mainly result due to exposure to asbestos. Typically the period of time between exposure to asbestos and visible onset of the disease is long. Thus many people who were exposed to asbestos decades ago are currently developing the disease. Opportunities to prevent these cancer illnesses were missed when the asbestos industry hid facts about the dangers of asbestos. Through numerous legal actions it has been proven that the asbestos industry was negligent for decades in hiding the serious dangers that result from asbestos exposure.


Although reported incidence rates have increased in the past 20 years, mesothelioma is still a relatively rare cancer. About 3,000 new cases of mesothelioma are diagnosed in the United States each year. Congress’s resolution to make Mesothelioma Day a national occasion speaks volumes in few words

If ever you’ve tried to read through a piece of proposed legislation, you know that it can be a daunting task.


That’s because bills are not designed to be literary works. Rather, they are highly technical documents, spanning hundreds or even thousands of pages.


Not so with regard to the resolution passed by the U.S. House of Representatives and Senate in 2009, designating each Sept. 26 as National Mesothelioma Awareness Day.


The resolution is relatively short – just a tad over 300 words. And, yet, in those 300-plus words, it manages to speak volumes about a health concern of enormous consequence for thousands of Americans – a matter known only too well by those of us at Weitz & Luxenberg, because our team of experienced personal injury lawyers has successfully championed mesothelioma victims for decades now.


However, on National Mesothelioma Awareness Day 2011, instead of our telling you what a fine resolution Congress crafted, you might find it more rewarding to read it for yourself. Here, then is, the full text of that brief but powerful resolution:


“Whereas there is no known safe level of exposure to asbestos;


“Whereas millions of workers in the United States have been, and continue to be, exposed to dangerous levels of asbestos;


“Whereas the National Institutes of Health reported to Congress in 2006 that mesothelioma is a difficult disease to detect, diagnose, and treat;


“Whereas the National Cancer Institute recognizes a clear need for new treatments to improve the outlook for patients with mesothelioma and other asbestos-related diseases;


“Whereas the need to develop treatments for mesothelioma was overlooked for decades;


“Whereas even the best available treatments for mesothelioma typically have only a very limited effect, and a person diagnosed with mesothelioma is expected to survive between8 and 14 months;


“Whereas mesothelioma has claimed the lives of such heroes and public servants as Admiral Elmo Zumwalt, Jr., and Congressman Bruce F. Vento;


“Whereas many mesothelioma victims were exposed to asbestos while serving in the Navy;


“Whereas it is believed that many of the firefighters, police officers, and rescue workers who served at Ground Zero on September 11, 2001, may be at increased risk of contracting mesothelioma in the future; and–


“Whereas cities and localities throughout the United States will recognize September 26, 2009, as ‘Mesothelioma Awareness Day’: Now, therefore, be it Resolved, That the Senate designates September 26, 2009, as ‘‘National Mesothelioma Awareness Day’’; and calls on the people of the United States, Federal departments and agencies, States, localities, organizations, and media to observe National Mesothelioma Awareness Day with appropriate ceremonies and activities.”

Australian Scientists Test New Strategy for Mesothelioma Treatment


In a country that has the highest rate of mesothelioma in the world, scientists at a university in Adelaide, the capital city of South Australia, are working on what they are referring to as a new strategy for mesothelioma treatment.


In a story on Yahoo7 News, Associate Professor Sonja Klebe from Flinders University said her work targets key growth factors that feed the mesothelioma tumor”.


“A completely different strategy to what anyone else has done so far,” she noted, adding that their work involving drugs and gene therapy has shown promise thus far in animal trials.


The scientists in Adelaide believe they’re racing the clock as health officials predict a third wave of mesothelioma sufferers to appear soon. Even though asbestos is now banned in Australia and exposure has lessened, the third group of mesothelioma victims will most likely be home or business owners who participated in do-it-yourself projects, failing to recognize the asbestos materials encountered during renovations and/or failing to follow proper procedure while removing asbestos, including wearing protective masks to prevent inhalation of the material’s tiny, sharp fibers.


“There is definitely a prediction of a third wave,” Professor Klebe noted. “Children that have been present during home renovation. The housewives who wash the clothes of the home renovator – shaking the dust out of those clothes.”


“It is important research because it affects so many people… so any research that can be done to prolong life, make life more comfortable, is excellent,” said former electrician Peter Beinke, who was diagnosed with mesothelioma about a year ago.


Because the disease often takes decades to develop, it is difficult to predict future cases, but Australian health officials have noted the disease will most likely peak in that country at about 900 cases annually by the year 2020.

Many of the rescuers and first responders were working without protective gear or breathing masks. Investigations continue into the lasting effects of 9/11.


The protective fire-retardant uniforms and other apparatus that firefighters utilize may also pose health hazards.  Some older firefighting gear was crafted with durable asbestos fibers to enhance its resistance to heat.   Once the fibers wear down, however, the toxic asbestos fibers are released into the air presenting a very serious health hazard.

Record Mesothelioma Verdict In California Against Owen Illinois

Congratulations to my friends Joe Satterly , Andrea Houston and the rest of the trial team  for an amazing result in this take-home exposure case.

 The plaintiff offered to prove that the defendant was fully knowledgeable about the dangers of asbestos, conducted animal studies demonstrating same  and failed to provide any warning whatsoever.  A product that issue was an asbestos insulation product used extensively throughout the United States called “Kaylo.”

The jury returned a verdict of $16,342,500 in compensatory damages ($12,000,000 to Mrs. Grigg, $4,000,000 in loss of consortium and $342,500 in economic damages).  Today the jury returned an $11,000,000 punitive award.  There was an intentional tort finding and the setoffs will be about $3,000,000 for settlements.  

 An appeal is likely. The defendant will no doubt argue that the verdict was excessive. This case demonstrates how some juries become very unhappy when they believe information about a product’s dangers was known but intentionally withheld.

Johnson Family Advances Mesothelioma Research with $500,000 Pledge to The Pacific Meso Center

LOS ANGELES, Feb. 13, 2013 /PRNewswire/ – The Pacific Meso Center (PMC) gratefully acknowledges the generous pledge of $500,000 from the family of John Johnson, a military veteran who passed away from malignant pleural mesothelioma (MPM).  John Johnson’s story and his horrific treatment by the U.S. legal system during his asbestos lawsuit which led to his early demise were chronicled by Michael Hiltzik in a Los Angeles Time’s article (http://articles.latimes.com/2012/apr/22/business/la-fi-hiltzik-20120422). Instead of being angry, the family is now challenging others, particularly attorneys involved in asbestos litigation to donate to PMC. The Johnsons will match such donations up to $500,000 thereby creating a $1 million fund which will be used for a collaborative research program with the Department of Veterans Affairs.


Mesothelioma is a diffuse and aggressive cancerof the chest lining (pleura) that is strongly associated with exposure to asbestos. Over one-third of the approximately 3,000 Americans who are diagnosed with mesothelioma each year served in the U.S. military.


“We want to help other families get diagnosed as early as possible, so that patients have a fighting chance to survive,” said Sue Johnson, widow of John Johnson. Her pledge was prompted in part by the care her husband received at the VA. “Dr. Robert B. Cameron did everything he could surgically to save John, but by the time he was diagnosed, he was already stage III.”


The Johnson family is hopeful that their pledge will jump-start the proposed Admiral Zumwalt Comprehensive Mesothelioma Research and Treatment Program at the VA. The program’s name-sake, Admiral Elmo Zumwalt, the United States’ Chief Naval Officer from 1970 to 1974, was exposed to asbestos while serving on Navy ships and passed away from MPM in 2001. The Admiral Zumwalt Comprehensive Mesothelioma Research and Treatment Program would be located within the West Los Angeles VA Medical Center.


PMC works in collaboration with doctors at the West Los Angeles VA and UCLA Medical Centers, who have extensive experience in treating this malady, to develop significant advancements in the diagnosis and treatment of MPM.  PMC’s scientific advisor, Dr. Robert B. Cameron, has been treating MPM patients for over 20 years.  He focuses on treatments which “spare” the lung and treat MPM as a chronic disease.  Dr. Cameron will be chairing the 3rd International Symposium on Lung-Sparing Therapies on Saturday, May 18th, 2013 at the Sheraton Delfina Hotel in Santa Monica, CA.
